He has particular experience acting on complicated disputes ranging from corporate-commercial to munici- pal and elections law and has been lauded by clients, judges and the media alike. He has appeared regularly before the Superior Court of Justice on behalf of large institutions and government clients. Frankel represented seven Members of Parliament in a series of Fed- eral Court applications collectively referred to as the "robocalls case." He acted as lead counsel for the Town of Georgina in a precedent-setting case in which the plaintiff alleged that building inspectors have a duty to report occupational health and safety concerns. Frankel has also acted as lead arbitration counsel on several franchise disputes and mining disputes, and as co-counsel on a $200-million commercial lending dispute. As lead counsel in more than 30 successful mediations, he has also been an eff ective proponent of alterna- tive dispute resolution. Frankel was called to the Ontario Bar in 2004. Partner and leader of Harrison Pensa's Class Action Group with an emphasis on securi- ties, competition law, pensions, consumer law and copyright law, among others. An expe- rienced litigator with exposure to virtually all aspects of class-actions practice, including an emphasis on class-action trials. Has also achieved substantial settlement results totaling more than C$150 million across a wide range of matters. He is known for his sound advice on commercial class-actions, securities litigation and product liability matters. He also represents clients on business crime investigations and fraud re- covery. As Chair of Baker & McKenzie's Canadian Class-Actions Group, Gadsden draws on his extensive class action experience, having acted for defendants and plaintiff s in na- tional and global class actions involving allegations of product liability, securities fraud and price-fi xing. He is known for his pragmatic advice on fraud prevention and investigations, and has extensive expertise in 'Ponzi scheme' litigation and asset recapture, including cross- border tracing, Anton Piller orders and Mareva injunctions. Gadsden has appeared at all levels of court in Ontario and in complex commercial arbitrations. He has completed the Osgoode Intensive Trial Advocacy Program, as well as the Intensive Advocacy Training Program conducted by the National Institute of Trial Advocacy. He is a highly ranked energy lawyer with expertise in oil and gas, LNG, electricity and utility matters. He represents energy, natural resource and other regulated companies in administrative proceedings, ar- bitrations, mediations and litigation in court. His practice includes representing regulated companies in a variety of matters, including project assessments and permitting, rates and rate design, cost of capital/return on equity, and compliance with mandatory electric reli- ability standards. His clients in regulatory matters include the largest natural gas utility in BC, electric transmission and distribution companies, federally and provincially regulated oil and gas pipeline owners, thermal energy utilities, a compulsory auto insurance provider and a ferry operator.
