PRODUCT LIABILITY
Glenn Zakaib is a partner practicing in the area of commercial litigation. His practice
focuses on product liability (drug and medical devices, automotive and aviation products,
industrial equipment, electrical equipment, home appliances) and class proceedings
(product liability, life insurance, misrepresentation claims, Competition Act claims). Za-
kaib has been involved in numerous precedent-setting and leading class-action cases. He is
a member of the Defence Research Institute (DRI) Product Liability Committee, Drug
and Medical Device Committee, and International Committee, and is recognized as a
leading lawyer by Chambers Global, PLC Life Sciences Handbook, Best Lawyers and
the Who's Who of Life Sciences Lawyers. Zakaib is a Fellow of the Litigation Counsel of
America. He is also immediate past Canadian Regional Director with DRI, immediate
past Chair of the DRI International Committee, immediate past Chair of the Interna-
tional SLG and the Vice-chair of the Automotive SLG with the Product Liability Com-
mittee for the DRI. Zakaib was called to the Ontario Bar in 1983.
Mary M. omson is the head of the Advocacy Department in Gowlings' Toronto of-
fi ce and national leader of the fi rm's Product Liability practice. She is one of Canada's
pre-eminent practitioners in the areas of class actions, mass tort litigation, product liabil-
ity, pharma litigation, health law, consent law and privacy issues. omson has more than
30 years of experience representing clients before the courts, public inquiries, profession-
al regulatory bodies and other administrative tribunals. omson routinely acts as Cana-
dian lead and coordinating counsel in class actions and manages complex litigation across
Canada through robust project management. She combines her substantial courtroom
experience with an ability to supervise high-functioning teams providing detailed legal
analysis, delivering solid value and providing dedicated client service. omson works
closely with clients, assisting them in defi ning and implementing the necessary strategic
plan for their litigation.
Brian Kapusianyk practices in the areas of insurance and commercial litigation with an
emphasis in professional liability, construction law, commercial insurance coverage and
defense, as well as personal injury and products liability litigation. He has acted on mat-
ters in British Columbia, Alberta, Saskatchewan, Manitoba, Ontario and Yukon Terri-
tory. He has appeared in the courts at all levels, including the Federal Court, Trial Divi-
sion, the Federal Court of Appeal and the Supreme Court of Canada. Kapusianyk has
been retained to act for architects, engineers, land surveyors, lawyers, accountants and
many other professionals. Has been recognized in various publications, including Lex-
pert® magazine, e Best Lawyers in Canada, e Lexpert®/American Lawyer Guide to the
Leading 500 Lawyers in Canada, and the International Who's Who of Insurance & Rein-
