Tony Creber is a senior partner with Gowlings and is its senior IP litigation counsel.
Tony's primary focus has been in chemical, biotech and pharmaceutical patent litigation.
His practice includes trade-mark litigation, regulatory issues and advising on IP life cycle.
Creber has been consistently recognized by e Best Lawyers in Canada and Lexpert® and
other similar directories as a leading lawyer in litigation, IP and biotechnology. He regu-
larly appears in the Federal Court as well as the Supreme Court of Canada on patent mat-
ters, including questions of patentability of life forms, patent licensing and the infringe-
ment of biotech patents. Important cases he has appeared in include the SCC decisions
in Schmeiser and Plavix. Most recently he represented Novartis in protecting its patent on
Gleevec and Biotech Canada in an access to information case before the SCC, which cor-
rected a restrictive interpretation of the trade secret exemption. Creber won the coveted
"Patent Case of 2009," "Practitioner of the Year 2014" and "Milestone Case of 2014"
awards given by Managing Intellectual Property.
Has practiced exclusively in IP litigation for 30 years. In-depth experience advising cli-
ents on IP litigation strategies, conducting discoveries, examinations and cross-examina-
tions, and preparing highly persuasive arguments to be presented in court. Among the top
fi ve most experienced IP litigators in Canada. Has appeared before the courts of Québec
and the Federal Court of Canada. More than 100 of the cases he has been involved in have
been reported in Canada. Named Canada's Trademark Litigator of the Year (2013 and
