His services are often retained by companies with restructuring needs and by court-appointed officers, financial institutions, secured and unsecured creditors and purchasers of assets from distressed companies. He has acted for several financial institutions and companies in connection with informal workouts and debtor-in-possession financings. Roy has participated in numerous major restructurings and receiverships, in a broad range of industries, including construction, manufacturing, saw mills, pulp and paper, technology, pharmaceutical, mining, retail and real estate. He also acts in cases involving liability of directors and officers. Bill Kaplan has extensive experience in virtually all litigation matters related to business law. He has a particular practice focus on corporate commercial matters, insolvency law, including numerous cross-border cases, securities law matters, and corporate governance issues. Kaplan has appeared before all levels of the courts system in British Columbia, the Supreme Court of Canada, the Federal Court of Canada, the BC Securities Commission and numerous other administrative tribunals and arbitration boards. Kaplan has practiced in the full range of dispute resolution contexts from traditional trials and related pre-trial procedures to arbitrations and mediations. Kaplan is currently an Adjunct Professor of law at the University of British Columbia, teaching in the area of negotiations. Kaplan received his LLB from the University of British Columbia in 1979, he was submitted to the Bar in British Columbia in 1980, received an LLM degree from Harvard University in 1981 and was appointed Queen's Counsel in 2001. His practice focuses on insolvency matters, having appeared regularly before Alberta's Bankruptcy Court and Court of Appeal, as well as having made submissions to the Ontario Court of Appeal and the Supreme Court of Canada. Mann has acted for lenders, debtors, receivers/trustees, creditors/counterparties, DIP financiers and acquisitors in a variety of insolvency proceedings. Mann has also had extensive involvement with financial/derivatives contracts in insolvency proceedings and has participated in legislative advisory committees respecting Alberta's Civil Enforcement Act, registered savings plan protection, and Bankruptcy and Insolvency Act reform.
