David Kent is the National Co-chair of McMillan's Dispute Resolution Group and its Class Action Practice,
and a member of its Competition and IP groups. His practice emphasizes complex litigation, including
competition, copyright, commercial and regulatory disputes. His extensive class-action experience includes
over 60 national matters comprising hundreds of actions in cases involving competition, consumer, privacy
and securities claims across numerous industries, raising issues such as cross-border discovery, settlement
and certification. Counsel in many competition law cases, including over 40 cartel class actions (e.g.,
vitamins, cross-border vehicles, credit cards, e-books, Gmail, auto parts and electronics components such as
DRAM, SRAM, LCDs and CRTs), as well as private actions, contested mergers and Competition Bureau
investigations. Kent taught ADR at Osgoode Hall Law School and Queen's University Law School for nine

James Musgrove is Co-chair of the competition and antitrust practice at McMillan LLP. He practices
primarily in the areas of competition, antitrust and foreign investment law and advises on antitrust,
distribution and competition law matters, mergers, cartels and Investment Canada matters. Musgrove
is winner of the GCR award for Behavioural Matter of the Year ‒ Americas for his successful defense of
MasterCard, in 2014, and was named Advertising and Marketing Lawyer of the Year, Toronto, by Best
Lawyers. Leading competition law cases include the defense of the NutraSweet company, MasterCard,
Polaroid, West Fraser Timber and the Toronto Port Authority at the Canadian Life and Health
Insurance Association. He is recognized as a leading competition and advertising lawyer by various rating
organizations, including Chambers Global, GCR, Lexpert®, Best Lawyers and Who's Who Legal, amongst
others. He is Past Chair of the Canadian Bar Association National Competition Law Section,
