Is there any judicial guidance on litigation funding
in Canada?
e sole Canadian case on commercial litigation funding is Schenk v Valeant Pharmaceuticals.
Justice McEwen held that funding of commercial litigation is permissible, as long as the funder
does not stir up or control the litigation, and the funder's return is not excessive.
