persistent obstacles for miners — especially in British
Columbia, where less than half the province is open for
mineral exploration.
"It used to be that legislatures set out the rules, but
now we're seeing many more decisions and policies that
have been formulated by administrative tribunals and
securities commissions to whom extensive powers are
being devolved," he says. "And the courts are not being
as consistent as they should be."
Abraham is not alone in his views, either. Charles
Kazaz in the Montréal office of Blake, Cassels & Gray-
don LLP says that the notion of "social acceptability"
has made major projects "very difficult" endeavours for
mining developers in Q uébec.
