Also has considerable experience in addressing deregulation issues in both the gas and

Peter Feldberg is the Firm Managing Partner of Fasken Martineau. His practice
extends to all aspects of utility regulation and energy project development, including
environmental and Aboriginal matters. He acts as lead counsel for applicants to power
generation and electricity and gas transmission projects, advises and represents clients on
legislative and regulatory requirements, public consultation, environmental assessments
and sits on contested applications and appeals. Feldberg has experience with Canada/
US electricity matters, including commercial, jurisdictional and international law issues.
He is an experienced litigator through all levels of court, including the Supreme Court
of Canada. Widely recognized by several legal publications as a leading practitioner,
Feldberg is also a member of the Energy Bar Association. He was called to the British
Columbia Bar in 1984 and the Alberta Bar in 1996.

James Smellie's practice focuses on energy regulatory matters, administrative law and
litigation. He has extensive experience representing a wide range of stakeholders in the
energy industry before federal and provincial regulatory tribunals, including in respect
of facility approvals, rate and tariff issues and export/import authorizations, as well as
on specifi c projects such as the Sable Off shore Energy/Maritimes & Northeast Pipeline
Projects, the Mackenzie Gas Project, the proposed Alaska Pipeline and the Maritime
Link component of the Lower Churchill hydro-electric project. His litigation focus
includes commercial arbitrations, both as counsel and arbitrator, as well as appearances
in the provincial and federal superior and appellate courts, and the Supreme Court of
Canada. He is widely recognized by his peers and in several ranking publications, includ-
