Many clients, that is many of you, are retaining more than one firm to handle your litigation; indeed you may be retaining several. Law firms have adapted to this new reality. They are analyzing and presenting their specializations and core strengths. What legal services do we do best? And how can they be funded in the clients' best interests? Could we, for example, provide certain defined deliverables on a flat-fee basis? This has moved beyond litigation that would readily be called "commoditized" and into cases that are merely repeated. Even a few years ago, law firms might have said, there are too many variations among files even of the same genre to name a flat fee — they were still thinking of the varying hours on the respective files. Those same firms are adapting their systems in order to predict a flat fee for their services. There is still "bet the farm" litigation out there. However, even on these cases, clients are asking for predictability to the extent possible, as well as a partnership voice in the case strategy. Successful law firms now and in the future are satisfying both of these requests. In this edition, we present Canada's highest-ranked litigation lawyers in the practice areas indicated. These rankings are based on peer surveys, which have a participation rate that exceeds 80 percent. In Lexpert's view, these rankings provide another level of predictability — in the very hiring of litigation lawyers. Who are these lawyers, you ask?
